Effective Date: 6 May 2026
This Acceptable Use Policy ("AUP") applies to everyone who uses the Hatch Service, including organizational customers, administrators, HR personnel, role managers, and workers. It is incorporated by reference into our Master Services Agreement, our End-User Terms, and our Terms of Service.
By using the Service, you agree to follow this AUP. We may suspend, restrict, or terminate access to the Service for violations.
1. General prohibitions
You must not use the Service to:
- Violate any law or regulation
- Infringe any intellectual-property right of a third party
- Defame, harass, threaten, or stalk any person
- Engage in or promote violence, hate, terrorism, or unlawful discrimination
- Distribute malware, spyware, ransomware, or any other harmful code
- Probe, scan, or test the security of the Service without our prior written consent
- Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
- Reverse-engineer, decompile, or extract source code from the Service except as expressly permitted by law
- Use the Service to provide a competing service or to benchmark it without our consent
- Resell, sublicense, or share access except as expressly permitted by your contract with us
2. Content you must not upload
You must not upload, submit, or otherwise input into the Service any of the following:
Illegal or harmful content
- Content that is illegal in your jurisdiction or in Georgia
- Child sexual abuse material (CSAM); any depiction of minors in sexual contexts
- Content depicting non-consensual sexual activity
- Detailed instructions for creating weapons (including chemical, biological, radiological, nuclear, or cyber-weapons), explosives, or otherwise causing mass harm
- Content that promotes self-harm, suicide, or eating disorders
Personal data you have no lawful basis to share
- Personal data of individuals where you do not have a lawful basis under applicable data-protection law to share that data with us
- "Special category" / sensitive personal data (data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, genetic data, biometric data, health data, or data concerning sex life or sexual orientation) — except where you have explicit, informed consent from the data subject and a documented justification for processing it through an AI-enabled learning platform
- Personal data of children under the applicable age of digital consent (typically 13–16)
- National identification numbers, financial account numbers, payment-card data (full PAN), or other identifiers regulated by sector-specific laws (e.g., HIPAA, PCI-DSS), unless your contract with us specifically permits this category and the necessary safeguards are in place
Content you do not have rights to
- Copyrighted material you do not own and are not authorized to use
- Confidential information of third parties (other companies' trade secrets, NDAs you signed, etc.) without permission
- Materials subject to export-control restrictions you have not cleared
Content that conflicts with the Service's purpose
- Material unrelated to your organization's training or learning goals (e.g., personal files)
- Content intended to manipulate the AI into producing prohibited output ("prompt injection", "jailbreaking")
- Bulk uploads of personal data unrelated to the documents' learning content
3. Use of AI features
You agree:
- Not to use the chatbot or generated content as the sole source of medical, legal, financial, safety, or other professional advice
- Not to present AI-generated content to your workforce as something authored by a named human, where doing so would be misleading
- Not to use quiz analytics as the sole or primary basis for hiring, promotion, termination, compensation, or disciplinary decisions about workers (this is a contractual restriction; it also reduces both parties' exposure under the EU AI Act and similar regulations)
- To clearly disclose to your workforce that the chatbot and learning materials are AI-generated, where local law requires such transparency
- To verify outputs before relying on them for any consequential decision
4. Account integrity
- Keep your credentials confidential
- Do not share your account with others
- Do not create accounts using false information
- Notify us immediately if you suspect unauthorized use
5. Reporting violations
If you believe someone is violating this AUP, email hatch.officiall@gmail.com with details. If you believe content on the Service infringes your intellectual property, send a notice to hatch.officiall@gmail.com including: identification of the work, identification of the allegedly infringing material, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the rights holder.
6. Enforcement
We reserve the right to:
- Investigate suspected violations
- Remove content that violates this AUP
- Suspend or terminate access for violations
- Cooperate with law enforcement and regulators
- Recover from you any loss we suffer due to your violation
We will give reasonable notice before suspending access where practicable, except in urgent or legally required cases.
7. Changes
We may update this AUP. Material changes will be communicated through the Service or your registered email. Continued use after changes constitutes acceptance.
